Any visitor wishing to purchase product through our website will be redirected to Kyani, Inc (http://www.kyani.net) to do so.  All product transactions take place over a secure connection provided by Kyani, Inc.  We do not assume any liability or responsibility for your information once you are no longer visiting thekyanidream.com or any of its subsidiary pages.

All online visitor data collected by thekyanidream.com is protected against unauthorized access. We will not sell, trade, or give your personal information to other companies or organizations.

Anonymous and random data may be collected by a third party company (Google Analytics) from your computer based on individual computer and browser settings to be used by thekyanidream.com to better manage and serve you, the visitor.  These data and statistics will not be sold, traded or given to any other company or organization and will only be used by thekyanidream.com staff to make necessary adjustments to better improve your visit to thekyanidream.com.

Paying members of thekyanidream.com (members who have a personalized site with thekyanidream.com) agree to have their picture, name, phone number, and e-mail address accessible to those whom they direct to their site or those who find it on their own.  We will not sell this information to anyone.  However, members of thekyanidream.com agree to allow us to show their information on their personalized site.

Children’s Privacy

Member Web Site Terms of Use

As a paying and active member of thekyanidream.com, you agree to provide us with your information (photo, name, phone number, e-mail address) and allow us to display such information on your personalized site for public viewing.  We do not control who can browse to your site, so we consider your personalized thekyanidream.com page to be public just like any other site.

Member Responsibilities and Rights:

1. You allow thekyanidream.com to use your personalized information that you have submitted to be uploaded to thekyanidream.com servers and posted on your personalized website for anyone and everyone to see and use.
   1. You may change your personalized information at any time by e-mailing contact@thekyanidream.com and detailing the changes that you would like to be made.
      1. All changes will be made within 3 business days.
   2. You will be given a themed personalized site to use at your discretion that does not include the site source files, images, or FTP, SSH, or other transfer protocol access. All changes to the site will be and can only be made by thekyanidream.com staff.
2. You may post a link to your personalized website anywhere on the internet, newspaper, magazines, or forums you deem worthy of such a link.
3. You agree, depending on the payment plan you select, that payments will automatically be charged to you on the renewal period, unless you unsubscribe from your personalized website, at which time, your site will be suspended until subscription is renewed.
   1. Once payment is received for a subscription period, no refund, pro-rated or wholly, will be given if user cancels subscription.
      1. Example: Paying for a 6-month subscription will give you 6-months of a hosted, unlimited bandwidth, site.  Canceling after 1-month will NOT give you a refund of the unused portion of your subscription, but cancel your website after your 6-month paid subscription period has ended.

Thekyanidream.com Responsibilities and Rights:

1. We agree not to sell, trade or give your personal information out in list or individual form to any other company or organization.
2. We are not responsible for visitors to your site, or calls or e-mails sent to you through the information that is shown on your personalized site.  Once again, we display it publicly for all to view.  However, we WILL NOT, post links anywhere to your personalized site.

Rules of Engagement:

This Agreement is governed by the laws of the State of Utah, without regard to principles of conflict of laws.

To the extent you have in any manner violated or threatened to violate thekyanidream.com and/or its affiliates’ intellectual property rights, thekyanidream.com and/or its affiliates may seek injunctive or other appropriate relief in any state or federal court in the State of Utah, and you consent to exclusive jurisdiction and venue in such courts.

Any other disputes will be resolved as follows:

If a dispute arises under this agreement, we agree to first try to resolve it with the help of a mutually agreed-upon mediator in the following location: Salt Lake City, Utah. Any costs and fees, including attorneys’ fees associated with the mediation will be paid by the non-prevailing party.

If it proves impossible to arrive at a mutually satisfactory solution through mediation, we agree to submit the dispute to binding arbitration at the following location: San Salt Lake City, Utah, under the rules of the American Arbitration Association. Judgment upon the award rendered by the arbitration may be entered in any court with jurisdiction to do so.

Earnings Statement:
